What a Stud Dog Contract Should Cover

Identification of both dogs. Full registered names, registration numbers, breeds, dates of birth, and colors for both the stud and the bitch. This sounds like paperwork for its own sake, but it's what ties the contract to the actual dogs—and it's what the kennel club will expect to match when the litter is registered.

The stud fee and when it's paid. Spell out the amount, the due date (commonly on or before the first mating), and whether any portion is refundable. Ambiguity about money is the single most common source of stud disputes.

What happens if the breeding doesn't take. No mating is guaranteed to produce a pregnancy. Most stud contracts address this with a return service clause: if the bitch doesn't conceive, the bitch owner is entitled to a repeat breeding on her next heat, usually at no additional stud fee. Decide—and write down—how many return services you offer, whether they transfer to a different bitch, and what counts as proof the breeding missed (typically a vet's confirmation).

Health testing on both sides. The contract should require current health certificates for both dogs, including breed-appropriate genetic testing and a recent brucellosis test. Brucellosis deserves special mention: it spreads through breeding, causes abortion and sterility, and a single infected mating can end a stud dog's career. Reputable stud owners require a negative test from the bitch, and bitch owners should expect the same in return.

Litter notification and registration. The bitch owner typically agrees to notify the stud owner within a set number of days of whelping, and to list the stud as sire when registering the litter. The stud owner's cooperation on signing registration paperwork should be spelled out too.

Anything unusual—in writing. Pick of the litter, co-ownership arrangements, breeding restrictions on resulting puppies, or a right of first refusal on puppies all belong in the contract, not in a text message thread.

Common Stud Fee Arrangements

There's no single "correct" way to structure a stud fee, but three arrangements cover most breedings:

1. Flat cash fee. The simplest arrangement: a fixed amount paid before or at the time of breeding. Typical fees vary enormously by breed, titles, health testing, and proven production—everything from a few hundred dollars to several thousand.

2. Pick of the litter. Instead of cash, the stud owner takes first pick of the resulting puppies. This can be worth far more than a cash fee for a strong litter, which is exactly why the contract needs to define when the pick happens, at what age, and what occurs if there's only one live puppy.

3. Cash plus pick, or a split. Hybrid arrangements are common for highly sought-after studs. They're also where handshake deals go wrong most often—if the arrangement has more than one moving part, every part belongs on paper.

Whichever structure you choose, address the edge cases while everyone is still friendly: What if there's a singleton litter? What if the pick puppy dies before pick-up? What if the bitch owner decides to keep the whole litter?

Disputes a Good Contract Prevents

Almost every stud service dispute traces back to a scenario nobody wrote down. The recurring ones: a bitch that didn't conceive and a bitch owner who assumed unlimited free return breedings; a stud owner who expected the litter registration to list their kennel name; disagreement over who pays for progesterone testing or shipping semen; and pick-of-litter arrangements where both parties wanted the same puppy. None of these require a lawsuit to resolve when the contract already answers them—and all of them can poison a breeder relationship when it doesn't.

A signed contract also protects the dogs themselves. Requiring health clearances in writing gives both owners a polite, non-negotiable way to insist on testing that protects the bitch, the stud, and the resulting puppies.

5. Puppies: If the mating results in a pregnancy, the Bitch Owner agrees to notify the Stud Dog Owner within ______ days of the birth of the puppies. The Bitch Owner agrees to register the puppies with the appropriate kennel club and to list the Stud Dog Owner as the sire of the litter.

6. Right of Refusal: The Stud Dog Owner shall have the first right of refusal to purchase any puppies resulting from the mating at a price to be mutually agreed upon by the parties.

7. Indemnification: Each party agrees to indemnify and hold the other harmless from any and all claims, damages, or liabilities arising out of the performance of this Agreement.

8. Entire Agreement: This Agreement contains the entire agreement of the parties and there are no other promises or conditions in any other agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties.

9. Amendment: This Agreement may be modified or amended if the amendment is made in writing and is signed by both parties.

10. Governing Law: This Agreement shall be governed by the laws of the State of ________________________.

11. Severability: If any provision of this Agreement shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Agreement is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

12. Waiver of Contractual Right: The failure of either party to enforce any provision of this Agreement shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Agreement.
